Terms of Service
These Terms of Service ("Terms") govern your use of the HankyDoodle iOS app and related services (the "Service"), operated by Hankinsoft Development, Inc. ("Hankinsoft," "we," "us," "our"). By creating an account or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to use the Service. If you are between 13 and the age of majority in your jurisdiction, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. The Service is rated for users 12 and older on the App Store; the 13-year minimum here applies to account creation specifically.
2. Your Account
You sign in using Sign in with Apple or Google Sign-In. You are responsible for the security of the underlying Apple ID or Google account and for all activity that occurs under your HankyDoodle account. Notify us promptly if you believe your account has been compromised.
3. License to Use the App
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the Service on Apple devices you own or control, for your personal, non-commercial use. All other rights are reserved.
The HankyDoodle app is licensed (not sold) to you. The Apple End User License Agreement ("Apple Standard EULA") also applies to your use of the app on Apple devices. If there is a conflict between these Terms and the Apple Standard EULA, these Terms govern except to the extent required by the Apple Standard EULA.
4. User Content
"User Content" means anything you create, upload, or submit using the Service, including drawings, captions, usernames, avatars, and reports.
You retain ownership of your User Content. You grant Hankinsoft a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, transmit, and create derivative works of your User Content as needed to operate, maintain, moderate, and improve the Service. This license survives the retention of backups and copies kept for legal, audit, or moderation purposes.
How drawings reach the Gallery. The Service has a unified community Gallery (browsable as the Word Gallery and the Showcase). Drawings made in a multiplayer round, drawings made for the Word of the Day, and free-draw sketches you choose to share are all written into the same Gallery corpus when you submit them. Multiplayer and Word of the Day submissions are added automatically as part of the gameplay loop; free-draw drawings only reach the Gallery if you explicitly use the "Submit to Word Gallery" flow.
Your control over Gallery visibility. The "Private Account" toggle in Settings hides every Gallery drawing tied to your account (existing and future) until you turn it off. The toggle is account-wide; the Service does not currently offer a way to delete or hide a single Gallery drawing on its own. If you believe one of your own Gallery drawings should be removed for moderation reasons, you can use the Report flow on it and the moderation team will review it on the timeline described in Section 6.
Account deletion does not remove Gallery drawings. Deleting your account from within the app (Settings › Account Settings › Delete Account) anonymizes your account and removes your operational and personal data (profile, push tokens, friends, blocks, premium balance, and similar). It does not delete the Gallery drawings tied to your account; those remain visible in the Gallery and are attributed to "Deleted user." If you want your Gallery drawings excluded from the public corpus before or after account deletion, turn on Private Account first.
Promotional use of Gallery drawings. Because Gallery drawings are publicly browsable by every user of the Service by design, you also grant Hankinsoft a worldwide, royalty-free, sublicensable license to use Gallery drawings to promote the Service. We may reproduce, display, adapt, resize, caption, and share Gallery drawings on the App Store, on Hankinsoft-owned websites, and on third-party social media platforms (for example Instagram, X, TikTok, Bluesky, Threads, Facebook, and Reddit), including in screenshots, animations, and short video clips. Where reasonable, we will credit your then-current displayed username. This promotional license is sublicensable to platforms that require a license to host the post.
Turning on Private Account, or asking us to remove a specific Gallery drawing through the moderation flow, stops Hankinsoft from making further promotional use of the affected drawings going forward. We are not required to take down promotional posts already published on third-party platforms before that point - those platforms have their own removal flows that you can use directly. Drawings that never reach the Gallery - for example free-draw sketches you never submit - are not licensed for promotional use and remain governed by the narrower operational license above.
5. Acceptable Use
You agree not to upload, post, or transmit User Content that:
- Is unlawful, defamatory, harassing, threatening, or invasive of another's privacy.
- Is sexually explicit, gratuitously violent, or otherwise objectionable.
- Promotes hate, discrimination, or harm against any group.
- Depicts or facilitates the abuse or exploitation of minors.
- Infringes the intellectual-property rights or publicity rights of others.
- Contains malware, spam, phishing attempts, or links intended to compromise others.
- Impersonates another person or misrepresents your affiliation with anyone.
- Violates the terms of any third-party service the Service depends on (Apple, Google).
You also agree not to interfere with the Service, reverse-engineer it beyond what applicable law allows, abuse rate limits, or use it to harvest information about other users.
6. Reporting and Moderation
Zero tolerance for objectionable content. HankyDoodle includes user-generated content, and we take reports seriously.
From any drawing or user surface in the app, you can:
- Report content you believe violates these Terms.
- Block another user, which hides their content from your view and prevents further interactions.
We commit to reviewing reports of objectionable content and taking appropriate action within 24 hours of submission. Appropriate action may include removing the content, suspending or terminating the reporting or reported account, or no action where the content does not violate these Terms.
We are not obligated to monitor User Content proactively, and we are not responsible for the actions of users. Removal decisions are at our sole discretion. If your content is removed and you believe the removal was in error, you may appeal by emailing kyle@hankinsoft.com.
7. Termination
You may stop using the Service at any time. You can delete your account from within the app at Settings › Account Settings › Delete Account, or by emailing kyle@hankinsoft.com. What deletion does and does not remove is described in Section 4 under "Account deletion does not remove Gallery drawings."
We may suspend or terminate your access if you violate these Terms, engage in abusive behavior, or if continuation of your account would expose us or other users to harm or legal risk.
8. Changes to the Service
We may add, change, or remove features at any time. We may also stop offering the Service, in whole or in part. We will provide reasonable notice for material changes when feasible.
9. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy. We do not warrant that the Service will be uninterrupted, error-free, or secure.
10. Limitation of Liability
To the fullest extent permitted by law, Hankinsoft and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim arising out of these Terms or your use of the Service is limited to the greater of (a) the amount you paid us for the Service in the twelve months before the claim, or (b) twenty Canadian dollars (CAD 20).
11. Indemnification
You agree to indemnify and hold harmless Hankinsoft from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your User Content, your violation of these Terms, or your violation of any rights of another.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Province of Nova Scotia and the federal laws of Canada applicable in it, without regard to conflict-of-laws principles. You agree that any dispute arising out of or related to these Terms or the Service will be resolved in the courts of the Province of Nova Scotia, and you submit to the exclusive jurisdiction of those courts. Where required by law, this section does not deprive you of consumer-protection rights granted by the laws of your place of residence.
13. Subscriptions and In-App Purchases
Some features of the Service are offered as paid subscriptions through Apple's App Store. Currently the Service offers a single yearly auto-renewing subscription, "HankyDoodle Premium," which removes the banner advertisement from the app and grants twelve (12) Superlikes per subscription year, replenished on each renewal, for the duration of the term.
- Payment. Payment is charged to your Apple ID account at confirmation of purchase, at the price displayed at purchase time.
- Auto-renewal. The subscription automatically renews for the same period (one year) unless cancelled at least 24 hours before the end of the current period. Your Apple ID account is charged for renewal within 24 hours prior to the end of the current period at the then-current price.
- Managing or cancelling. You can manage your subscription, view auto-renewal status, or cancel by going to your Apple ID account settings on the App Store after purchase. Cancellation takes effect at the end of the current paid period; refunds are not provided for the unused portion of a term.
- Family Sharing. The HankyDoodle Premium subscription is available through Apple's Family Sharing.
- Price changes. If we change the renewal price, Apple will notify you before the change takes effect and you will have the opportunity to cancel before being charged the new amount.
- Promotional offers. Free trials or introductory offers, if any, are governed by the terms shown at the time of the offer and convert to the standard auto-renewing price at the end of the promotional period unless cancelled beforehand.
Hankinsoft does not store or have access to your payment method or billing information. Apple processes all subscription transactions; we only receive a transaction identifier that allows us to grant the corresponding entitlement on your device.
14. Apple-Specific Terms
You and Hankinsoft acknowledge that these Terms are between you and Hankinsoft, not with Apple, and that Apple is not responsible for the Service or its content. To the extent these Terms provide for usage rules or restrictions that conflict with the Apple Standard EULA, the more restrictive provision applies. Apple is a third-party beneficiary of these Terms with the right (and accepted right) to enforce them against you as a user.
15. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the effective date at the top of this page. Material changes will be communicated through the app or by email when reasonably possible. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
